Worried about legal fees for matrimonial issues?

At FDC Law, we understand that many people will be worried about how they are going to fund a divorce, and that the process can often feel too intimidating to go through alone. Legal aid was abolished for most family matters in 2013 and is not available for divorce in the majority of cases (although there are exceptions where there has been a history of domestic violence in the relationship).

To try to help,  we are trialling a new reduced cost fixed fee divorce, provided by Abigail Whelan, for people who are eligible. This will include people who are on a low income or in receipt of certain state benefits.

Our fixed fee divorce service aims to simplify the divorce process for you. We will start by providing general advice in respect of the contents of the divorce petition and the requirements and grounds for divorce. We will then prepare the divorce petition on your behalf and guide you through the court process, including applying for the Decree Nisi and Decree Absolute, so you have our support from start to finish.

For the reduced cost service, we will charge £375 +VAT. The court also charges a fee of £550 to issue the divorce, which is payable in addition to our fees. However, you may be exempt from payment of the court fee or entitled to a discount, if you are on a low income.  Our standard fixed fee divorce is £500 + VAT and again the court fee is payable separately, so the new scheme offers a 25% discount.

The reduced fee option will be available for divorces and dissolutions during October or November 2020, where the work is carried out by Abigail Whelan. 

Please note, the fixed fee divorce does not include advice regarding children or financial issues – such as agreeing a pattern of contact or helping to negotiate a financial settlement. Details of what is included is set out in our fixed fee divorce leaflet, which can be downloaded here.

We always recommend that you have a financial order on divorce, and we understand that it can become difficult to agree contact arrangements with your partner during separation and beyond, so please do let us know if you also require assistance in relation to children or financial issues and we will discuss the likely costs of this with you separately.
