Powers of Attorney

At different times in our lives, we all have worries for the future. Will I be able to get a job? Which is the best school for my children? But as people get older, a question that is concerning more and more people is - who will look after my finances when I am no longer able to?

The answer is to appoint somebody else to look after your affairs through a Power of Attorney and consulting a specialist to help and advise on the issues and risks involved can often make the process more straightforward and stress-free and from the Attorney's point of view, the undertaking can be a considerable one as they deal with the affairs of a family member or friend who may no longer have the capacity to make decisions for themselves.

We have helped many of our clients to write Lasting Powers of Attorney (LPAs). An LPA is a document which gives authority to people that you trust so that they can handle your property and financial affairs and also take decisions about health and personal welfare. LPAs have to be registered with the Office of the Public Guardian before they can be used, we can help you through the process.

It is also worth remembering that there are different procedures in place if an individual loses capacity without a Power of Attorney in place. In this situation, an application for Deputyship has to be made in the Court of Protection. From a financial point of view, it is important to deal with these issues as early as possible because it can be much more expensive to apply for Deputyship through the Court of Protection rather than completing a Power of Attorney before capacity is lost.
