What happens if you die without a will?

If you die in England or Wales without a will, your estate will be allocated according to intestacy law.  If no eligible relatives can be found, your assets will pass to the Crown.

Where children under the age of 18 are involved, important decisions about their care and upbringing — including who will look after them and manage their finances — may be made by others instead of reflecting your preferences.

What type of will do I need?

  • Often used where children are under 18, or where beneficiaries need long-term financial protection
  • Can help control how and when assets are passed on, rather than giving them outright
  • May offer protection from financial risk, such as divorce, debt, or care fees
  • Allows trustees to manage the estate in line with the instructions set out in the will
